In Review: Last week, the Arkansas Insurance Department (AID) posted the notice of hearing for the new dispensing fee rule proposed by the AID and the Governor’s office. The proposed Rule 128 allows the AID to review pharmacy reimbursements to ensure that they are “fair and reasonable.” Click here to see the text of the rule and the notice of hearing. The media has been covering this issue and the role of the Governor’s staff in pushing this rule. PCMA expects that the AID may also run an emergency version of the rule as early as next week with an immediate effective date. There will be no opportunity for comment on the emergency rule, but we expect to provide written and oral comments through the formal rulemaking process.
