California Weekly Update 6.17.24

In Review: The Department of Insurance (DOI) held a conference call to review their amendments to SB 966 (licensing, reporting, AWP, delinking, ban on spread). There are numerous issues with their amendments, including expansive definitions and the potential exposure of confidential data as well as preventing PBMs from using the state’s Administrative Procedures Act to address decisions and actions taken by the department. This will force PBMs to use the court system to challenge adverse department decisions and actions.

Up Next: SB 966 is set to be heard in the Assembly Health Committee on June 25 and in the Assembly Judiciary Committee on July 2. We will send written comments to the respective committees once they publish the newest bill with any recommended amendments.
