In Review: Governor Gavin Newsom’s (D) Health Care Budget Trailer package was passed by the legislature and signed on Monday, June 30. The package included the Governor’s PBM legislative language, which required extensive licensing and reporting language, and PBM fiduciary to the plan. SB 41 Author Senator Scott Wiener (D) has made several amendments to his bill in an effort to conform with the Governor’s PBM budget trailer bill language, but retains delinking and a ban on spread pricing.
Up Next: The hearing on SB 41 is set to be heard in the Assembly Health Committee on Tuesday, July 8. We have been told the Chair will have amendments striking the NADAC reimbursement language and Medi-Cal dispensing fees as well as expanding the exemption of Taft-Hartley plans to all ERISA plans. The fact that the Chair has amendments means she intends to advance the bill out of committee.
