In Review: Last week, Governor JB Pritzker (D) used his State of the State Address to blame PBMs for the high costs of prescription drugs. PCMA responded immediately with a press release correcting the record and defending the industry. The governor also released his legislative proposal dubbed the “Prescription Drug Affordability Act,” which highlights a ban on steering, ban on spread pricing, eliminating the ability of PBMs to classify any drug as “specialty drugs,” ban PBMs from retaining rebates, create reporting requirements, and allow the Department of Insurance to “fully examine PBMs’ books and records.” As of today, a bill draft has not been released, and details of the legislative provisions are not known.
