In Review: Senate Bill 140 was passed by both chambers and now awaits consideration by the Governor. Problematic provisions on vertical integration, mail-order, and specialty pharmacy were removed from the bill. A NADAC plus Medicaid dispensing fee will be used for pharmacies that do not sell liquor. Those that do sell liquor will receive actual acquisition cost plus “a reasonable dispensing fee.”

Up Next: The legislative session has concluded. PCMA will monitor passed legislation for the Governor’s signature or veto.
