In Review: The House debated the kitchen sink anti-PBM bill, SF 383, last Monday. While an amendment that removed the cost drivers and narrowed the number of pharmacies eligible for the enhanced dispensing fee was offered, it did not receive enough votes to move forward. The House then passed SF 383 by a vote of 75-15. As a reminder, the bill includes language that defines a chain pharmacy that excludes chains from receiving the enhanced dispensing fee (but still includes Hy-Vee, which is the local grocery store pharmacy that has approximately 136 stores in the state) as well as broad pharmacy appeal rights, any willing pharmacy requirements, a pass-through pricing mandate, 100% rebate pass-through, bans on preferred pharmacy networks, and copay accumulator programs.
Up Next: The legislation now awaits action from Governor Kim Reynolds (R), who has 30 days from adjournment to sign or veto the bill—though she is expected to act sooner.
