Kentucky Weekly Update 1.13.25

In Review: The Kentucky General Assembly convened last Tuesday, January 7. PCMA is currently tracking three pieces of legislation: SB 12 (POS Rebates), SB 13 (3 Medicaid MCOs), and SB 14 (340B Drug Manufacturer Discrimination). Senator Steve Meredith (R), the Senate Health Services Chair, filed all three bills. Separately, members have heard anecdotally that the Department of Insurance (DOI) is receiving a steady stream of complaints from pharmacists against PBMs for non-compliance with SB 188. Members are working to find out any specifics of the complaints.

Up Next: The General Assembly primarily focused on the state budget during its first week and has adjourned until February 4. PCMA has requested a meeting with Sen. Meredith on his legislation. Additionally, PCMA has a scheduled meeting with Senator Max Wise (R) to discuss compliance with SB 188 and address other issues with the law’s implementation. Finally, in late December, the Board of Pharmacy issued emergency and formal rules outlining requirements for pharmacies to share information related to the cost of dispensing study performed by the Department to establish its dispensing fee. PCMA is soliciting feedback from members by January 27.
