In Review: The Kentucky General Assembly convened its 2024 legislation session on January 2. For the first few weeks, the legislature will focus on a budget to send to the Governor. While the larger PBM bills were expected this year (similar to HB 457 from 2022) and others, there is legislation impacting mail-service pharmacies and 340B. Specifically, HB 190 (Mail-Service) would prohibit a health plan from requiring or incentivizing an insured to use mail-order services, including imposing more restrictive cost-sharing than at retail.
Up Next: Next week PCMA has scheduled meetings with Senator Michael Nemes (R) and Representative Emily Callaway (R), members of the Interim Health Services Committee who expressed interest and had questions about the industry. The meetings will largely be educational and address the mischaracterization of SB 50 (Single PBM/PDL). PCMA is also waiting on a set meeting with the bill sponsor of HB 190, Representative Scott Sharp (R), and is sharing information on the bill with third-party allies, including the Kentucky Association of Health Underwriters, the Kentucky Association of Manufacturers, and individual employers.
