In Review: Last Friday, PCMA participated in a call with the Executive Director of the Kentucky Board of Pharmacy (BOP) and their general counsel to discuss the implementation of SB 188, specifically regarding the dispensing fee that will be paid to ‘independent retail’ pharmacies. Currently, there is no system to provide the pharmacy classification to PBMs so that they can properly pay the dispensing fee. The Board acknowledged that they are working with the DOI to create a system to share information, including pharmacy classification information. Problematically, there is no definition in either the statute or through the BOP of ‘independent retail’ pharmacy, meaning there is no real integrity to the current system.
