In Review: On Monday, the Kentucky Department of Insurance (DOI) held a stakeholder meeting to discuss their interpretation and applicability of SB 188 relative to ERISA plans. In short, the Department held that while the NADAC+DF provisions do apply to ERISA plans, anything in SB 188 related to “steering” does not. Moreover, the DOI also stated that they will generally not exercise control over health plans domiciled in another state. PCMA and members will discuss any next steps on Wednesday’s call.
