Kentucky Weekly Update 2.24.25

In Review: Last week, HB 423, which contains prior authorization reforms passed the full House with a 91-0 vote. The bill, which was agreed upon by stakeholders, was amended to exclude Medicaid and as currently drafted, does not include prescription drugs as a part of any prior authorization exceptions program. Representative Kimberly Moser (R) also filed HB 685, which contains extensive reporting requirements for non-profit hospitals and their contract pharmacies. Similar language was introduced as a floor amendment to SB 14 (340B Price Discrimination) but was ultimately withdrawn. PCMA is continuing to monitor the legislation. Finally, Representative Myron Dossett (R) filed HB 614, which would repeal the dispensing fee currently being paid to pharmacies. Anecdotally, PCMA has heard the bill was filed because of constituents being exposed to paying the dispensing fee at independent pharmacies. While the bill is not expected to move forward, PCMA is working to amplify the unintended consequences of SB 188.

Up Next: As a part of SB 188 ,the Department of Insurance (DOI) is required to promulgate rules outlining data elements for a cost of dispensing survey that is to inform the DOI as they develop their dispensing fee for plan year 2027. However, the Board of Pharmacy (BoP) issued its own rules outlining extensive information from pharmacies. PCMA will be contacting the BoP and DOI asking for clarification on the matter.
