In Review: The Senate Committee on Insurance advanced HB 264 on Wednesday. Following several weeks of negotiations, the Committee produced a product that included a rebate pass-through requirement, NADAC reimbursement minimums for local pharmacies, enhanced PBM transparency requirements, and prohibitions on affiliate steering, spread pricing, and effective rate pricing. The measure did not include any provisions on delinking or forced pharmacy closures.
Up Next: The Senate made a series of technical amendments and then voted to advance HB 264 by a unanimous vote. The bill now awaits a motion to concur in the House. PCMA continues to engage lawmakers in opposition to efforts by the Governor’s office to include delinking or forced pharmacy closures in any conference committee report. Session ends on June 12.
