In Review: Montana legislators are actively filing bill titles, with 12 related to PBMs and prior authorization currently under review. Bill language has been provided for LC 1957 (prior authorization), which addresses requirements for asthma and insulin medications, both branded and generic—key issues that continue to generate concern among stakeholders. Additionally, LC 304 (affiliate steering, gag orders, private right of action) impacts contractual agreements and has drawn criticism for its overly broad scope and ambiguous language. These concerns highlight potential unintended consequences for various stakeholders, including PBMs, health plans, and providers. At this time, no hearings have been scheduled for either bill.
