Montana Weekly Update 4.28.25

In Review: House Bill 740 (dispensing fee, AWP, mail-order, effective rate contracting) has been returned from enrolling and is awaiting transfer to the Governor’s office. During this window, constituent outreach from both supporters and opponents remains highly active. Efforts to encourage a veto are particularly strong among seniors, conservative Republicans in rural areas, Chamber of Commerce members, and the Frontier Institute. SB 447 (prior authorization) has been returned from enrolling, while the President of the Senate has signed SB 449 (prior authorization). Representative Jonathan Karlen’s (D) prior authorization bills, HB 398, have been returned from enrolling, and HB 399 has been signed into law. PCMA did not oppose either bill, as both were negotiated by the health plans. SB 422 (prior authorization) has passed the legislature with PCMA’s amendment striking “associated conditions” intact and has been returned from enrollment. Finally, HB 317 (addressing prior authorization) has been sent to the Governor for signature, with PCMA’s amendments— including protections against manufacturer price gouging during shortages—preserved. SJ 33, the interim study of the prescription drug supply chain and pharmacy sustainability, passed the Senate 49-0 on April 22; passed House Business and Labor Committee 20-0 on April 24, and is scheduled for second reading on April 28, with a third reading required for final passage.
