In Review: The legislature adjourned sine die on June 7. Three PBM-tracked bills were passed by both Houses and will now head to Governor Kathy Hochul (D) for consideration: A.9764/S9040, a bill to add the term “service” to the existing law that prohibits PBMs from penalizing a pharmacist or pharmacy from disclosing information; a step therapy bill, A.901A/S.1267A, which expands a prescriber’s ability to override a step therapy protocol; and A.1219A/S.1974A, a bill dealing with workers’ compensation plan pharmacy networks. Among the failed bills were proposals regarding NADAC and dispensing fee mandates, rebate pass-through, gold carding, white bagging, additional step therapy bills, drug supply chain transparency, and a health data protection bill.
