In Review: Last week, SB 479 (decline to fill, fiduciary, point-of-sale rebates, affiliate parity) was passed out of the Senate Commerce and Insurance Committee after adopting a Proposed Committee Substitute (PCS) with minimal changes to industry priorities. The bill will head to the Senate Finance Committee after this week’s break. Additionally, HB 163 (NADAC +DF, spread pricing, point-of-sale rebates, affiliate parity) was passed out of the House Regulatory Reform Committee and will head to the House floor after a stop in the House Rules Committee. Finally, HB 434 (gold carding) passed out of the House Health Committee with a hefty fiscal note. This bill and the more favorable SB 315 will likely head to a conference committee later in session.
Up Next: With the legislature on a week-long break, PCMA and member companies are working on outreach to Nathan Babcock, Senate Policy Advisor, to discuss some of the remaining issues in the bill, namely the fiduciary mandate and point-of-sale rebate provisions. Additionally, the team on the ground will be checking in with Senator Benton Sawrey (R) on any additional changes to the bill.
