In Review: Last week, SB 479 (decline to fill, fiduciary, point-of-sale rebates, PSAO regulation) was amended and passed out of the Senate Finance and Rules Committee and will likely be voted on by the full Senate early this week. The amendment still does not address the industry’s remaining concerns (fiduciary, point-of-sale rebates, affiliate parity), adds potentially problematic definitions of ‘retail community pharmacy’, and further exempts the state employee health plan from having to implement any of the requirements outlined in the legislation. Additionally, HB 163 (NADAC + DF, spread, point-of-sale rebates, affiliate parity) passed out of the House 106-9.
Up Next: Ahead of a likely floor vote on SB 479, PCMA and local member counsel will be meeting with members of Senate leadership to discuss industry concerns with the bill.
