North Dakota Weekly Update 1.27.25

In Review: The bill we knew was coming from the North Dakota Pharmacists Association was introduced as HB 1584 (ERISA), which most notably removes the ERISA exemption from the definitions of “Covered Entity” and “Pharmacy Benefits Manager.”  We are working to get the Greater North Dakota Chamber, as well as clients energized to oppose this bill. A prior authorization bill (SB 2280) was introduced which is very similar to the bill from the 2023 legislative session that was studied during the interim.

Up Next: A hearing on HB 1216 (copay accumulator) was rescheduled from last week to today in the House Industry, Business, and Labor (IBL) Committee. PCMA submitted a letter of opposition to the committee. A hearing will be held on Tuesday in the House Human Services Committee on both HB 1451 (Anti-Obesity Medical Assistance Coverage Mandate) and HB 1452 (Anti-Obesity Coverage Mandate). PCMA will submit a letter on HB 1452.
