North Dakota Weekly Update 4.28.25

In Review: PCMA submitted its veto letter to the Governor’s Office on HB 1584 (remove ERISA exemption). It is our understanding that none of the coalition members submitted veto letters. The Governor signed SB 2280 (prior authorization) into law on April 21. SB 2370, which formerly was an insulin copay bill but was amended (or, as some refer to it, hoghoused) to be a 340B reporting bill. The bill had two Conference Committee meetings and was amended to be a study bill regarding prescription drug transparency reporting under the federal drug discount program (i.e., 340B). The bill passed the Senate and was placed on the House calendar. Finally, even though the House Appropriations Committee gave HB 1216 (copay accumulator) a “Do Not Pass as amended” recommendation, it still passed the Senate, and the House concurred with the language and passed the House. The fiscal note for the bill indicated it would have a $4.45M financial impact on the Uniform Group Insurance Program.

Up Next: There is talk that the legislature will adjourn early, possibly as early as Wednesday, April 30.
