In Review: The Oklahoma legislature will convene on February 5. The Attorney General has proposed emergency and permanent PBM regulation. The Emergency Regulations must be approved by the Governor by January 11. The proposed permanent rules will still need to go through the legislative process and must be submitted in their final form no later than March 1. While it does not appear that the AG has statutory authority, the proposed McCortney Bill, SB1390, with some amendments, could give the AG the authority needed to have the permanent PBM regulations approved in the 2024 session.
