South Dakota Weekly Update 1.30.26

In Review: On Thursday, the House Health and Human Services Committee held a hearing on HB 1085, which would require preferential treatment of the coverage of nonopioid prescription drugs and place restrictions on prior authorization for such drugs. PCMA, insurers, and others testified in opposition to the bill. The Committee, by a vote of 10 – 3, deferred the bill to the 41st day, which, for all intents and purposes, kills it. There is a chance this may be “hoghoused” or added on to another bill during the session, so PCMA will be monitoring. The gold carding bill, HB 1199, and an artificial intelligence bill, SB 169, that places requirements on how health carriers make determinations relative to health care services, were introduced on Thursday.
