South Dakota Weekly Update 2.20.26

In Review: The prior authorization/gold carding bill, HB 1199, was heard in the House Health and Human Services Committee on Tuesday. PCMA spoke to the sponsor and other stakeholders and got an amendment that exempted prescription drugs from the bill. The amendment was adopted, passed out of Committee, and on Thursday, passed on the floor of the House. On Wednesday, a bill dealing with a health carrier being able to recoup, recover, or retroactively deny previously paid claims, HB 1292, was heard in the House Commerce and Energy Committee. PCMA worked with the sponsor to draft an amendment that exempted prescription drugs from the bill. The Committee adopted the amendment, and the bill passed out of Committee by a vote of 12-1. Finally, the bill, which would have placed onerous requirements on the use of artificial intelligence systems by health carriers in making various determinations, such as prior authorization, SB 169, was withdrawn at the request of the prime sponsor.
