In Review: The Tennessee General Assembly convened its 2024 session on January 11. PCMA is currently tracking two companion bills, White Bagging (SB 502/HB 916) and POS rebates (SB 667/HB 920), which carried over from the 2023 session. While no immediate action is anticipated or known at this time, either bill could be put on an agenda in their respective committees. Additionally, an amendment (which does not improve the bill) for SB502/HB916 has been drawn up and agreed to by TN Blue Cross Blue Shield. PCMA and local counsel have met or will be meeting with the bill sponsor on POS rebates to see if it is a priority for him. Additionally, the Tennessee Hospital Association has expressed interest in a stakeholder meeting on white bagging legislation. Finally, and more recently, Chairman of the House Insurance Committee has shown interest in an additional piece of drug pricing legislation, according to local counsel. The local team will be working to find out more about any additional details.
