Wisconsin Weekly Update 1.16.24

In Review: Last week, PCMA met with Senators John Jagler (R-Watertown) and Rob Hutton (R-Brookfield), who sit on the Senate Insurance and Small Business Committee where Senate Bill 737 received a public hearing. Senator Jagler stated that he is opposed to the bill, while Senator Hutton has not indicated his position on the bill. It remains unknown if SB 737 will receive a committee vote. PCMA will continue to meet with lawmakers and share our concerns with the SB 737.

In addition to Senate Bill 737, PCMA is monitoring nine separate pieces of legislation relating to PBMs. They are:

  1. SB 100 /AB103 – copay coupons
  2. SB 618 / AB 654 – prohibiting DHS from implementing utilization management controls for prescription drugs in the MA program
  3. SB 705 / AB 626 – Duty of a pharmacist to dispense lawfully prescribed drugs and devices
  4. AB 836 / SB 807 – Prohibiting step therapy protocols for certain cancer drugs.
  5. AB 849 / SB 783 -Therapeutic interchange for drug products prescribed to counteract anaphylaxis.
  6. AB 747 / SB 718 – PDAB Creation
  7. Senate Bill 719 – Omnibus health motion including cost caps on insulin, 340B changes, prescription drug importation program, pharmacy benefit tool grants, state creation of drug purchasing entity, licensure of PSAOs, Insulin Safety Net program
  8. AB 584 / SB 574 – Cost sharing cap on Insulin, $35
  9. Assembly Bill 176 – Pharmacy can prescribe contraceptives

PCMA supports AB 176 and has a chance to pass the legislature. As for the other bills, PCMA is monitoring or opposed. At this time, nothing that PCMA is opposed to is expected to pass including SB 100/AB 103, AB 836/SB 807, AB 849 / SB 783, AB 584 / SB 574, or Senate Bill 719.
