In Review: The Florida legislature adjourned last week with only one PBM-related bill advancing. HB 697 by Representative Kincart Jonnson (R), upon passage, was a much narrower bill that did not include benchmark pricing, frozen formulary, or a prohibition on PBM affiliate manufacturers.  PCMA and member company efforts with the bill sponsors and leaders in both chambers resulted in a bill that was heavily mitigated before final passage.

Florida Weekly Update 3.6.26

In Review: PCMA and members have been working all session on HB 697 by Representative Kincart Jonnson and SB 1760 by Senator Brodeur.  HB 697 and SB 11760 are “companion” measures that address similar PBM issues.  Before passage in the House, PCMA and our members were successful in mitigating the most problematic provisions in the bill. On SB 1760, PCMA and our members continue to work to address one final issue, related to PBMs and affiliate manufacturers.  We have received a commitment from the Senate Sponsor to amend that provision of the bill and anticipate seeing the amendment before the bill is on the Senate floor.

Up Next: Next week will be the final week of the session in Florida, and we will keep a close eye on HB 697 and SB 1760 as things wrap up.

Florida Weekly Update 2.13.26

In Review: PCMA and member companies continue meeting with Representative Jennifer Kincart Jonsson (R) on HB 697 and Senator Jason Brodeur (R) on SB 1760. PCMA spoke this week at the hearing on SB 1760, expressing our concerns with the bill as written. Since then, PCMA and member companies have been working with staff on language to mitigate the bills. Additionally, HB 1263 was introduced this week, the Department’s clean-up bill addressing a number of issues. Specific to PBMs is the language that could unfavorably modify the Department’s Market Conduct Exams.

Florida Weekly Update 2.6.26

In Review: PCMA and member companies have been meeting regularly with Representative Jennifer Kincart-Jonsson (R), HB 697, and Senator Jason Brodeur (R), on SB 1760. This week, PCMA presented both authors with our primary concerns regarding their legislation, focusing on affiliated manufacturing, frozen formulary, and other industry concerns. PCMA is working with members to provide alternative language to address our primary concerns and, where possible, mitigate these bills.

Up Next: PCMA anticipates that SB 1760 will be heard in the first committee this coming Wednesday, while HB 679 may be heard in its third committee next week.

Florida Weekly Update 1.20.26

In Review: Last week, Senator Jason Brodeur (R) filed SB 1760, which covers a variety of PBM topics, like appeals, transparency, and pharmacy reimbursement. The bill also includes language that would essentially prohibit PBMs from having an affiliated manufacturer. Sen. Brodeur historically has been vocal against PBMs and is likely to push this bill aggressively.

Up Next: PCMA will be in Tallahassee this week to meet with legislators and staff on SB 1760 and several other PBM-related bills. As of today, no bills have been set for a hearing.

Florida Weekly Update 12.15.25

In Review: Last week, HB 697 by Representative Kincart Jonsson (R) received support from House Speaker Danny Perez (R). The bill encompasses a range of topics and is designed to have a broad impact on all stakeholders within the healthcare system. PCMA’s team is currently reviewing and will provide our thoughts to PCMA members. Additionally, PCMA’s legal department remains in close contact with the Office of Insurance Regulation.

Up Next: Five rules will be up for consideration during the Cabinet meeting on Wednesday, December 17. The intent is to clarify the office’s approach to market conduct examinations and enable the office to conduct orderly and systematic examinations of regulated entities more effectively. PCMA’s legal team has reviewed the meeting notice and draft rules.
